Welcome to Sitedrop (“we,” “our,” or “us”). By accessing or using our website located at sitedrop.co.uk (the “Site”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use our Site.
1. Nature of Our Service
1.1 The Platform: Sitedrop is an online directory and introduction service that connects construction workers (“Labourers”) with recruitment agencies and construction companies (“Employers”).
1.2 No Employment Relationship: Sitedrop is not an employment agency. We do not employ Labourers, nor do we act as a payroll provider. We simply provide a database of contact information.
1.3 Verification: While we encourage Labourers to provide accurate information regarding their skills and CSCS certification, Sitedrop does not physically verify CSCS cards, identity documents, or right-to-work status. It is the sole responsibility of the Employer to verify these documents before allowing a worker on site.
2. User Accounts
2.1 Registration: You must create an account to access certain features. You agree to provide accurate, current, and complete information.
2.2 Security: You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities that occur under your account.
2.3 Eligibility: You must be at least 18 years old and based in the United Kingdom to use this Site.
3. Terms for Labourers
3.1 Profile Accuracy: By creating a profile, you warrant that all information provided (including trade, experience, and location) is accurate and truthful.
3.2 Availability: You agree to keep your availability status up to date.
3.3 No Fees: Sitedrop is free for Labourers. We do not charge you a fee to join, nor do we deduct commissions from your wages.
3.4 Employment Contracts: Any work agreement is formed directly between you and the Employer. Sitedrop is not a party to this contract.
4. Terms for Employers (Agencies/Companies)
4.1 Paid Access: Access to Labourer contact details (phone numbers) requires a paid subscription or one-time access fee (“Employer Access”).
4.2 No Sharing: Employer accounts are for single-user or single-entity use only. Sharing login details with other agencies or third parties to avoid paying fees is strictly prohibited and will result in immediate account termination without refund.
4.3 Hiring: You acknowledge that you are solely responsible for interviewing, vetting, and paying any Labourer you contact through Sitedrop.
4.4 Usage Limits: Although we have an unlimited data access, we reserve the right to limit the number of profiles viewed per day to prevent data scraping.
5. Fees and Refunds
5.1 Payments: Fees for Employer Access are payable in advance via our secure payment processor.
5.2 No Guarantees: Purchasing access allows you to view data. It does not guarantee that a specific Labourer will answer the phone, accept your job offer, or show up for work.
5.3 Refund Policy: Due to the digital nature of the data (instant access to phone numbers), all sales are final. Refunds are only granted at our sole discretion in cases of technical error.
6. Prohibited Conduct
You agree not to:
- Use the Site to harass, stalk, or spam Labourers.
- Use automated scripts or bots to scrape data from the Site.
- Post false or misleading content.
- Resell or redistribute the contact data found on Sitedrop.
Due to GDPR Requirements, you must never save details of contacts out of Sitedrop without the persons permission as they have a right to know where their data is stored and can be deleted.
7. Limitation of Liability
7.1 Disclaimer: To the maximum extent permitted by UK law, Sitedrop excludes all liability for any loss or damage arising from your use of the Site.
7.2 Work Quality: We are not responsible for the quality of work, attendance, or conduct of any Labourer found through our platform.
7.3 Non-Payment: We are not responsible if an Employer fails to pay a Labourer.
7.4 Site Safety: We are not responsible for health and safety conditions on any construction site.
8. Termination
We reserve the right to suspend or terminate your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
